Thesis title: The Modern Goals of Competition Law: A Comparative Analysis of the European Union and China Approaches to Dynamic Efficiency
Abstract
The amendments 2022 to the AML and the enactment of a series of documents demonstrate a strong ambition to establish unified market rules throughout China. Policymakers have recognised that the current framework does not serve the interests of chinese market economy. Competition authority wishes to strike a new balance between competition and industrial policy, based on the development and long-term goal of sustained economic growth. Given its unique socialist background, China’s liberalisation is unlikely to follow the international norms. This requires an extensive exploration of the development of EU competition law and efficiency objectives, which have similarities but will eventually diverge due to unique contextual factors in both jurisdictions. Overall, this research is expected to contribute to the understanding of the interaction between state and market in China by doing comparative analysis with the EU and provide potential strategies for pursuing the appropriate dynamic efficiency to guide the developing of China’s competition policy under the socialist market economy.
Biography
Zhiyi is a PhD candidate at UCD Sutherland School of Law. He studied economic law as an undergraduate at Shanghai University of Political Science and Law (SHUPL). He then holds a LLM in International Corporate Law from University of Leeds (UOL), graduated with the dissertation in Distinction (re Killer Acquisitions in digital market). He has published articles in several Chinese journals (in Mandarin), covering competition law, criminal law, and sports injuries. Zhiyi has passed Chinese National Unified Legal Professional Qualification Examination and obtained the qualification certificate, having several internships at law firms. He has been awarded the 'Best Presentation Award' at the 3rd Symposium for Chinese Postgraduate in Ireland (2024.10)
Zhiyi is doing comparative legal study between EU and China. His primary research interests lie in international competition law, with particular focus on how the Dynamic Efficiency, as the essential economic theory, should be applied to achieve the objectives of competition law, and further explore the interaction between state and market.
