The records of the Medical Bureau of Road Safety are subject to the terms of the Freedom of Information Act. The Act gives individuals a right of access to information held in the records of the Medical Bureau of Road Safety, a right to have personal information held by the Bureau amended if it is found to be incorrect and right to obtain reasons for decision made by the Bureau that have materially affected them. It will be necessary to exempt from release certain types of information in some circumstances. There is an appeal procedure in place for requesters who are unhappy with the outcome of their request.
It is important that the public be aware that under the Freedom of Information Act the records of the Bureau are subject to the restriction provided for under section 46 (1) (bb). Therefore, records held or created by the Bureau, other than those relating to the general administration of the Bureau, are not accessible under the FoI Act. This means, for example, that records concerning alleged criminal offences under the Road Traffic Acts are not accessible under the FoI Act.
